Terms and conditions for taking part in the therapeutic holiday

Terms of Participation for Therapeutic Programs

Welcome to the Terms of Participation page of the FuerteVida Parkinson No Limits association. By confirming your participation in our “Therapeutic Holidays,” you fully accept the following terms. These conditions have been drafted to ensure the maximum safety of our participants, the transparency of our processes, and the financial sustainability of our non-profit association.

1. Nature of the Programs and Physical Fitness

FuerteVida Parkinson No Limits is a non-profit organization. Our programs are not commercial holiday packages, nor do they constitute medical treatment or hospital healthcare. The proposed activities are exclusively for the purpose of well-being, socialization, adapted movement and complementary therapeutic activities. The participant declares under their own responsibility that they are physically fit and do not have contraindications incompatible with the program.

2. Communication of Special Needs

To ensure a safe and tailored experience, the participant (or their guardian) must promptly communicate via the registration form any motor limitations, allergies, medical therapy, need for aids, or specific dietary requirements. Failure to communicate relieves the Association of any responsibility for the lack of program adaptation.

3. Booking Process and Financial Contributions

Each program is customized. The reservation will be considered final only upon receipt of the bank transfer confirmation (or the requested deposit). To comply with tax and transparency regulations, it is mandatory to indicate in the transfer reference: “Therapeutic program contribution [Participant’s First and Last Name]”. Each contribution is entirely intended to cover fixed costs and specialized staff. Additional individual services requested on-site from external professionals will be regulated and paid directly to the professional, with no economic or clinical link to the Association.

4. Cancellation and Refund Policy

The Association is dedicated to organizing high-quality therapeutic programs. As the organization involves immediate and non-refundable financial commitments to hotels, professionals, and logistics, if a participant withdraws, the following penalties will apply, calculated on the total fee:

  • Up to 45 days before the start: 50% of the total fee will be retained (equivalent to the deposit paid).

  • Between 44 and 30 days before the start: 75% of the total fee will be retained.

  • Less than 30 days before the start (or no-show): 100% of the total fee will be retained (no refund).

Important Notes:

  • Deposit: The 50% deposit is considered a booking fee. Once paid, it is non-refundable under any circumstances, as it covers the reservation and administrative costs already incurred by the Association.

  • Balance: The remaining balance must be paid no later than 45 days before the arrival date.

  • Exceptions: No exceptions to the cancellation penalties can be made for personal or medical reasons.

  • Interruptions: Unexpected absences, late arrivals, or early departures do not entitle the participant to any refund or price reduction.

 
Special Conditions for Groups

Due to the organizational complexity and the exclusive commitment of medical professionals, the following terms apply to group bookings:

  • Deposit: 50% of the total fee at the time of confirmation.

  • Balance: Must be paid no later than 60 days before the arrival date.

  • Group Cancellation Policy:

    • Up to 60 days before: 50% penalty (retention of deposit).

    • Between 59 and 30 days before: 80% penalty of the total fee.

    • Less than 30 days before: 100% penalty (no refund).

5. Force Majeure

The Organizer reserves the right to modify, postpone, or cancel the event in case of force majeure (bad weather, strikes, unforeseen closures, health emergencies, or security reasons). In such cases, any refund will exclusively concern the fees actually recoverable by the Association, and no additional compensation shall be due.

6. Safety and Medical Disclaimer

Health is our priority, but the participant accepts that physical activities involve natural risks. The Organizer and its operators are not responsible for falls, freezing, balance alterations, tremors, fatigue, or other physiological symptoms intrinsically linked to Parkinson’s disease. All activities organized directly by FuerteVida Parkinson No Limits are covered by our Civil Liability policy. It is strongly recommended to take out personal travel insurance covering accidents, cancellation, and healthcare.

7. Third-Party Providers and Transport

Hotels, restaurants, sports facilities, and external means of transport operate with total autonomy. The participant accepts that any deficiency, damage, or accident occurring in such facilities or means is the sole responsibility of the respective providers. The Organizer is not responsible for theft or loss of personal items.

8. Behavior and Role of Caregivers

Collaborative and respectful conduct is required. Hostile behavior, verbal or physical aggression, or continuous disturbance of the group will lead to the immediate expulsion of the participant, without the right to a refund. Caregivers accept that they do not have a medical role in the program. They must respect the operators’ instructions and cannot request clinical or nursing assistance from our staff.

9. Protection of Operators and Volunteers

Operators and volunteers act exclusively on behalf of the Organizer. They do not perform clinical health activities and have no personal responsibility toward participants. The participant expressly waives the right to attempt civil or criminal actions or claims against individual natural persons; any claim may only be exercised against the FuerteVida Parkinson No Limits Association.

10. Use of Images

By participating, the participant authorizes the free and non-exclusive use of photographs and videos taken during the stay for informative, promotional, and fundraising purposes of the Association. The withdrawal of consent shall only be valid for the future.

11. Acceptance and Competent Jurisdiction

The payment of the contribution implies having read, understood, and fully accepted these Conditions. For any dispute, the court of Puerto del Rosario (Fuerteventura, Canary Islands) shall have exclusive jurisdiction.
